Octai Terms and Conditions
Effective October 6, 2026.
These terms govern your use of the Octai app, offered by Anderson Gonzalez Acosta, an individual in Colombia (contact: support@octaiapp.com). By using the app, you accept these terms and Apple's standard Licensed Application End User License Agreement (https://www.apple.com/legal/internet-services/itunes/dev/stdeula/). If anything conflicts, Apple's agreement prevails regarding the license to the app.
The app
Octai is a notebook app for writing and drawing, with tools that tidy up what you write and artificial intelligence (AI) features. Some AI features run on your device and others use third-party cloud services (see the Privacy Policy).
Your content
- Your notebooks, notes, and drawings are yours. They are stored on your device, and we acquire no rights over them.
- You are responsible for what you write, draw, import, or send to AI. Do not use Octai to create or send content that is illegal, infringes the rights of others (for example, copyright or image rights), or is offensive.
- Make your own backups: if you delete the app or lose your device without a backup, your notes cannot be recovered, because they are not stored on any of our servers.
Artificial intelligence
- The AI's explanations, drawings, titles, and covers are generated by artificial intelligence: they may contain errors, inaccuracies, or unexpected results. Review them before using them.
- The AI's explanations are meant for studying and are not a substitute for professional advice (medical, legal, financial, or otherwise).
- Cloud features depend on third-party services and an internet connection. They may change, be limited, or become unavailable. They have a usage allowance (see "Octai Plus" below).
- Only what you ask for is sent to the cloud, and only after you accept each service's notice. You can withdraw that permission from your profile, on the notebooks screen → Privacidad y términos (Privacy and Terms).
- Use the AI's results in accordance with the law and the rights of others.
Purchases and subscriptions
- Free: the app and everything that runs on your device (writing, calligraphy, shapes, arrows, instant titles…) costs nothing. Cloud AI features (redraw, explain, AI titles and covers) include a free monthly allowance per device, shown on the Octai Plus screen.
- Octai Plus is an auto-renewable subscription, monthly or yearly, that raises that allowance to a much larger monthly one (also shown on the Octai Plus screen). Allowances are per calendar month and reset on the 1st. The price, what is included, and the duration are shown before you buy. The allowance exists because each use of Cloud AI has a cost; to prevent abuse there is also a per-minute limit and an overall daily limit, and in exceptional cases (for example, heavy demand or a provider outage) Cloud AI may be unavailable for a while. Allowances may be adjusted; if they are reduced for a subscription already paid for, you will be notified in the app reasonably in advance.
- Free trial: the first time you subscribe to Octai Plus there may be a free trial period (its length is shown before you subscribe), with a smaller allowance that is also shown. When it ends, the subscription is charged automatically unless you cancel at least 24 hours before, in your Apple Account settings. Apple offers the trial only once per account.
- Apple charges you through your Apple Account. Subscriptions renew automatically at the end of each period unless you cancel at least 24 hours before, in your Apple Account settings.
- Refunds: handled by Apple under its policies. You can request one at https://reportaproblem.apple.com. This does not limit any consumer rights you have under applicable law (in Colombia, Law 1480 of 2011).
- If you bought something, you can get it back on another device with the same Apple Account using "Restore Purchases".
Intellectual property
The app, its design, its name, its logo, and its code belong to its author or are used under license. Third-party services (Apple, Google, Meta, Black Forest Labs, YouTube) and their trademarks belong to their owners; mentioning them in the app only indicates which service is used.
Third-party videos
The study video feature plays videos from your Photos, your Files, or web links (for example, YouTube) using their players. That content belongs to its creators and is governed by each service's terms.
Liability
Octai is provided as is, with reasonable care to make it work well. To the extent permitted by law, the data controller is not liable for data loss caused by device failures or missing backups, or for content generated by third-party artificial intelligence services. Nothing above limits any rights you have under applicable law that cannot be waived.
Changes and end of service
These terms may change; the new version will be published with its date. If you keep using the app after a change, you accept the new version. You can stop using Octai at any time by deleting the app.
Governing law and contact
These terms are governed by the laws of the Republic of Colombia. If you live in another country (for example, the United States), you are also protected by your country's consumer laws that cannot be waived; nothing in these terms limits them. For any question, complaint, or claim, write to support@octaiapp.com.
These terms are available in Spanish and English. Both versions say the same thing; if they ever differ, the one more favorable to you applies.
